The following questions will help you determine if guardianship is something you may need for your disabled child:

  • Is your child capable of making his or her own medical decisions or will you need to be involved in those decisions after he or she reaches age 18?
  • Will you need the authority to speak with health insurance companies regarding your disabled child?
  • Will you be advocating for your child?

If the answer to the above questions is “yes”, you may need to petition for guardianship for your special needs child.
